Definitions

    1. Service Provider: Refers to Piyush N Jha, the individual entrepreneur and operator of newbharatskills.in, who offers the products and/or services under this Agreement.
    2. Client / You / Your: Refers to the individual or entity purchasing or participating in the services or programs offered by the Service Provider.
    3. We / Us / Our: Refers to the Service Provider.
    4. Investment: Refers to the total payment made (in part or full) for products, workshops, webinars, consulting services, or other offerings from the Service Provider.

Engagement

    By enrolling in any service, program, or purchasing any product offered through newbharatskills.in, you confirm that you have read, understood, and agreed to these Terms and Conditions. Your payment confirms your acceptance of this Agreement as a binding contract.

Payment Terms

    • The Investment must be paid in full unless an installment plan has been explicitly agreed to in writing.
    • For installment plans, all payments must be made on time and in full. Any missed installment shall make the full outstanding balance immediately due and payable without further notice.
    • The Investment amount excludes meals, travel, accommodation, or any other incidental expenses unless explicitly stated in writing.

Cooling-Off Period

    You may cancel your enrollment by providing written notice (including email) within 24 hours of your registration. Upon such cancellation:
    • A processing fee of 35% and applicable taxes will be deducted.
    • The remaining amount will be refunded within 30 business days.
    • No refunds will be processed for cancellations made after the 24-hour cooling-off window.

Cancellations and Refunds

    • Refunds will be granted only under the cooling-off clause. Beyond that, no cancellations or refunds are entertained.
    • You agree not to raise any dispute or claim for refunds post the 24-hour period.
    • Registration or program access is non-transferable.
    • If you fail to attend the session/event within the prescribed duration, your registration will lapse without refund.

Event Schedule and Venue

    • You are responsible for providing accurate contact details during registration. We are not liable for failed communications due to incorrect information.
    • We reserve the right to alter the event’s date, time, venue, speaker, or format with prior notice. In such cases:
      • You are not entitled to any refund or compensation.
      • You may be offered an alternate session, subject to availability.

Intellectual Property

    • All intellectual property used or developed by the Service Provider in the course of delivering services remains solely owned by the Service Provider.
    • You receive a non-exclusive, non-transferable, non-commercial license to use the materials for personal purposes only.
    • You must not:
      • Alter any material or intellectual property.
      • Record, distribute, or reproduce the sessions.
      • Use the content for commercial gain or unauthorized sharing.

No Guarantee or Warranty

    • We do not promise or guarantee specific outcomes, results, or success from your participation in our services or use of our products.
    • You are solely responsible for how you apply the knowledge, guidance, or tools provided.

Limitation of Liability

    To the fullest extent permitted by law, piyushnjha.com and its affiliates shall.
    • Not be liable for any indirect, incidental, special, or consequential damages.
    • Limit total liability to the actual amount paid by you under this Agreement.
    • Not be responsible for loss of profits, goodwill, reputation, or business opportunities.

Indemnification

    You agree to indemnify and hold harmless the Service Provider against any claims, damages, or expenses arising out of your actions, negligence, or participation in our programs or use of our products.

Force Majeure

    We are not liable for any failure to fulfill obligations due to causes beyond our control, including but not limited to acts of God, pandemics, natural disasters, riots, strikes, or system failures.

Data Usage and Communication Consent

    By registering or purchasing from piyushnjha.com, you:
    • Consent to receive communications via email, SMS, or phone, including marketing messages.
    • Agree to have your data stored securely for service delivery purposes.
    • May opt-out at any time by clicking “unsubscribe” in our emails.

Arbitration

    Any disputes arising from this Agreement will be resolved through arbitration under the Arbitration and Conciliation Act, 1996. The arbitration will be conducted in English, with a sole arbitrator appointed by the Service Provider. The venue of arbitration shall be Pune, Maharashtra.

Jurisdiction

    This Agreement is governed by the laws of India. You agree to submit to the exclusive jurisdiction of the courts in Pune, Maharashtra.

General Provisions

    • Any notice under this Agreement shall be served via email or registered post.
    • If any clause is found unenforceable, it shall be severed without affecting the remaining terms.
    • This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings.

Amendments

    We reserve the right to amend these Terms and Conditions at any time. Continued use of our services after such amendments constitutes your acceptance of the new terms.
